This guided wizard helps you prepare your divorce application for the Family Court of WA. Processing typically takes 25-35 minutes.

CRITICAL STEP - DO NOT SKIP
After completing your application on eCourts Portal, you MUST print and sign an Affidavit for eFiling (Divorce) before an authorised witness.

Step-by-Step Affidavit Process

  1. Complete Application on eCourts Portal
    • Complete Parts A to G of the online form
    • Save each part as you proceed
  2. Preview Your Application
    • At Part H, click "Preview" - a zip folder will open
    • Save your draft application
    • Click "Save for later" before exiting
  3. Print Required Documents
    • Print your completed application
    • Print a blank "Affidavit for eFiling Application (Divorce)" form
  4. Find an Authorized Witness
    • ✅ Justice of the Peace (JP)
    • ✅ Lawyer
    • ❌ Police officer, pharmacist, or teacher (UNLESS also a JP)
  5. Sign the Affidavit
    • Take BOTH documents to the authorised witness
    • The witness will review your printed application
    • Sign the affidavit in front of the witness
    • The witness will sign and stamp the affidavit
  6. Scan and Upload
    • Scan the sworn affidavit
    • Return to Part H of your eCourts application
    • Upload the sworn affidavit
  7. Complete Lodgment
    • Select "Lodge"
    • Pay the filing fee ($1,125 full / $375 reduced)

  • Completed divorce application printed
  • Blank affidavit form printed
  • Photo ID ready to show witness
  • Affidavit signed in front of authorised witness
  • Witness has signed and stamped affidavit
  • Sworn affidavit scanned as PDF

  • Proof of separation (if under one roof)
  • Citizenship/residency documents (if applicable)
  • Translation (if marriage certificate not in English)
